Terms of Service
Effective Date & Last Updated: November 8, 2026
Welcome to Pinery Seller Suite (“the Service”, “Pinery”, or “Software”). These Terms of Service constitute a legally binding agreement between you (“Merchant”, “User”, or “You”) and Pinery. By accessing or using our application, you agree to be bound by these terms.
1. Software License & Authorized Scope
Pinery provides an advanced operating system and automation platform integrating with Amazon’s official Selling Partner API (SP-API) and Amazon Advertising API. You are granted a non-exclusive, non-transferable, revocable license to utilize the Software strictly for lawful Amazon store management, inventory forecasting, profit auditing, and advertising optimization.
2. Amazon Developer Policies & Merchant Compliance
Users agree to strictly adhere to all applicable Amazon terms, including but not limited to:
- Amazon Selling Partner API Developer Agreement, Acceptable Use Policy (AUP), and Data Protection Policy (DPP).
- Amazon Seller Code of Conduct and Anti-Manipulation policies.
- Users shall not utilize the Software to execute unauthorized rank manipulation, spam buyer messages, or violate Amazon API rate limits.
3. Brand Owner Eligibility & Brand Analytics Provisions
Access to and utilization of features leveraging Amazon Brand Analytics (ABA) data are subject to specific verification requirements:
- Verification of Brand Registry Status: The Merchant affirms that they are a legitimate Brand Owner verified through Amazon Brand Registry (or a designated authorized representative) for each brand connected to the Software.
- Authorized Agent Representation: The Merchant authorizes Pinery to retrieve and analyze Brand Analytics data (Search Query Performance, Top Search Terms, Repeat Purchase Behavior, and Market Basket Analysis) exclusively on their behalf and for their own brand trademarks.
- Prohibition of Misuse: Neither Pinery nor the Merchant shall aggregate, benchmark across competing sellers, or distribute Brand Analytics data in contravention of Amazon’s Acceptable Use Policy.
4. Advertising Automation & Operational Safety
Pinery includes algorithmic automation tools such as Dayparting schedules and Auto Negative Keyword rules:
- Dry-Run Mode Safeguard: All rules default to “Dry Run (Simulation)” mode, where proposed changes are logged locally without dispatching mutation calls to Amazon.
- Merchant Discretion: Enabling “Live Mode” and the Master Execution Switch authorizes Pinery to transmit API mutations directly to Amazon Advertising API. Users retain full responsibility for verifying rule thresholds.
5. Subscription, 30-Day Free Trial & Activation
New store connections are granted a 30-day unrestricted free trial with all features enabled. Upon expiration of the trial period, continuous synchronization and automated job execution require activation via a valid commercial license code. Commercial licenses are non-refundable once generated and deployed.
6. Trademarks & Intellectual Property
Pinery software architecture, user interface, and proprietary algorithms are the intellectual property of Pinery. Amazon, Amazon Advertising, Selling Partner API, and related marks are registered trademarks of Amazon.com, Inc. or its affiliates. Pinery operates as an independent third-party tool and is not affiliated with or endorsed by Amazon.com, Inc.
